Personally I don't think a plea of insanity should ever be allowed. Killing another human being is not a sane act to begin with. So if you are capable of killing a human being...then you need to be culled from society one way or another. If judged insane, then off to the asylum with you and if not, then off to prison or execution. End of story.

There are some that hold to the idea that anyone who would willingly commit a crime, knowing that it is ilegal and they could get caught an severely punished MUST be insane.
That is why the determination isn't if you have some sort of mental disease, but rather do you know the difference between right and wrong and di you recognize that what you were doing was wrong.

1st, lets decide on what we want for our societal agenda,is it revenge, deterrent, or justice,are we going to decide under what circumstances is murder or killing justified? if it is revenge then the parties who were affected should be the ones to do the execution, if it is revenge then who is the most guilty, the 1st one to kill or the executioner? if it is only fair or justice,then who should make this decision? should some one born with a silver spoon in his mouth , who has never had to face life in the ordinary capable of making this decision for us, or should the people make this decision? the way our courts are set up the rule of law is if you kill you will die unless it is within a narrowly defined guidelines, same as any other law, unless you are a cop F,B,I, or some other branch of the gov, but, not if you are a solider fighting for your country, then your *** is mud, also since when has there been a fair court of law, since the prosecutor , cops, have a agenda , studies have shown as a deterrent death penalty has not been a successful deterrent ,

If killing is done while the individual knows the difference between right and wrong, they are legally sane. Therefore the "STATE" which kills is guilty of a legal murder. I think a killer should get life without parole in solitary confinement. Save us the expense of the automatic appeals that drag on for 15-20 yrs.

People who commit heinous crimes should be dealt with the same way you do a mad dog.
I am sorry, but I have a problem with someone like Andrea Yates, & Susan Smith,
anyone who sympathizes with them--needs to stand over the grave sides of these innocent babies and take a good look---at reality.
