Supreme Court justices are swayed because they are appointed by politicians. Thus, there is influence in the decision making by those in power.

I wouldn't know how to answer that question without having seen a bunch of case law on the subject.

For example, I've read a whole lot of case law on the Equal Protection Clause and I am very, very certain that the Court has not done a good job respecting the original intent on that one.

But I've never read one single opinion about the contract clause.
