stating that my name is on the lease there fore any check has to be on an account in my name.
I guess if my parents are writing the check it is a "Third Party' Check", There last name is the same as mine.

Do I have any legal recourse.

First you need to see what your lease says...if your lease specifically states that any check used to pay rent must come from an account with your name on it, then you're out of luck. However, how about getting a money order? Most money orders come with receipts that you can keep, so you can verify that the money order was cashed, and when you get a money order, YOU put your name on it, then your landlords name. It works just like a check when he goes to deposit it into his account. That's how we pay our rent, by money order, because we don't have a checking account.

It is pretty stupid on the part of the landlord. But if that is what the lease says then he has the right to do this. You don't want to bother with any legal recourse. I am sure a certified check or money order would work--but check your lease just to be careful.

That is a load of rubbish, you reposeabilty is only that the rent is pay on time, is does not matter if the check came from a third party. If he plays up again ask him to show you anywhere in the contract that the cheque has to be written from an account in YOUR name. If he then refuses to accept the cheque again, make him give you a sign written statement saying that he refuses on xxxx ground and be sure to have a third party witness hes refuse.

A landlord is perfectly in his right to refuse a check from anyone other than you.The lease agreement is with you,not your parents.And how is he to know that the check wasn't stolen,or that your parents might come back later and say they never wrote the check.He is just protecting himself from any possible problems.He has no legal agreement with your parents,therefore,he can refuse the check.

Sure, Have your parents deposit money in YOUR account and then write a check to your landlord.

This is WAY easier then suing the landlord.

Of course you can also stop paying rent altogether and when landlord files for eviction, claim at the hearing that landlord refused payment.

Your landlord is being a jerk. Legally he doesn't have to accept a check. A check is not legal tender. He may be trying to get rid of you. A crappy landlord is not a good situation- maybe you should rethink living there.

Your landlord can chose to refuse the check if he wants to. If your parents are paying for you why not just ask them to give you a money order?

have the check written to you then write a check for the landlord. he's being a jerk but what can you do ? he can accept the check if he wants but i guess he just wants to give you a hard time.

I think it is ridiculous. All you have to do is write "Rent for (your name here)...in the note part or anywhere on the check and it is a complete document, satisfying the purpose of which it is written.

You may, but its not worth it. Just tell your parents to write you a check and you write him a check or give him a cashier's check.
