I ate at Applebee's last week and got very sick. I ended up in the hospital. I reported it to the restaurant and am waiting to hear more from them. I don't want money, but it would be nice if they paid my hospital bills. The dr. ruled that it came most likely from the food, but the bacteria tests came back negative- meaning no E. coli etc.

Am I best of handling this myself or with an attorney?

My guess is they'd fight any lawsuit, especially if you have no evidence that it came from them, and no empirical evidence of food poisoning itself (other than your illness).

Are there other people who ate at the same time you did get sick? It's highly unlikely you'd be the only one. Maybe you could pool your experiences together.

Overall, I'd say you don't have a case.

Call your county public health department. Were other people made ill at the same time?
Yes, contact an attorney or legal aid and find out if you have a claim. When we eat in a public restaurant, there is always a risk of getting sick. The restaurant has a reasonable responsibility to serve healthty food, but what if what made you sick was what you
ate at home 4 hours earlier?

I hate to break this to you but I think it's best you take care of yourself. Applebee is a chained restaurant and it's very hard for you to sue them. Doc state that it mostly likely came from the food but does not say what kind of food. Applebee have their own attorney which will argue that doctor have no prove that it's applebee's food. It could be something you ate before Applebee as well...
I think it's best you handle this yourself. It's not easy trying to sue a restaurant esp when it's a chained restaurant.

You're wasting your time.

You have no proof that the poisoning was caused by Applebees. You can hire an attorney and spend thousands of dollars and months in court and maybe you'll win some sort of settlement but the only one that will win this case is whatever attorney you hire.

Chalk it up to a lesson learned... NEVER eat at that Applebees again.

Could it be possible you food poisoned yourself ?
In most cases food poisoning takes 12-24 hours to develop not 15 minutes after you eat.

Get an attorney.All applebees will say is your a dam lier,and ignor you.

they'll "put it under the rug" and pay or offer you something to make up with it so you don't sue them. my best advice is to only take legal action if it has lasting effects or the medical bill was large
