I live in Ca. and it was bought after we were married. And yes he still owes child support and is a cheater/lier. Won't be hard to prove he hasn't paid a dime.

In my opinion if you have a child the Condo should go to you and he should be paying child support. Get a good lawyer.

It depends on where you live, if other agreements were signed and if you can prove that he didn't contribute to the mortgage.

Did the Quitclaim Deed have language that stated the recording of the deed was for the sole purpose of establishing your sole and separate property? Consult with your attorney, but I'm pretty sure you're going to have to prove that he didn't make any contributions.

In California, a Quitclaim Deed means that someone is RELINQUISHING their interest in a piece of real property. And, as someone said earlier, a lot will depend on when the deed was signed and how long you've had the property.

Quit claim DOES NOT mean what the first guy said. It means that he has relinquished all rights to the property. You might still have to pay him a portion of the profits on the sale of the condo, but if I were you, I would get a good lawyer. It depends a great deal on whether you owned the condo before you were married or not.

I don't know about where you are from but here in Ohio after I signed a quit claim I wasn't entitled to anything on the house. If I recall, he had to refinance the house so that all the paperwork was just in his name.

Does he still owe child support? That can be deducted from any equity in the home. The equity in the home can be divided up many different ways...please see your attorney for this.

Quick claim means he is on the title and will be required to sign off when you sell. I don't think you will be able to get out of giving him half unless he willingly gives it up.
