My parked car was hit by a minor. I had to drive to the police station, after the girl gave me her name and #, to file a report because she was distraught and wanted to go home. The parents of this minor are making it very difficult for me to get my car fixed. I got 1 estimate and they said they will not pay for it since I am not going through their guy. I was directed by Toyota to a reputable place and that is where I want my car fixed. I am a single mother w/ 2 jobs and don't have time to drive around shopping for the cheapest price for someone who is at fault. I am not asking them to cut me a check. I want them to pay this place directly. I just want my car fixed. If they won't pay what other steps should I take to ensure that they do? Is this considered a hit and run?

The estimate of the repair shop is enforceable and must be respected by the other party. You have the right to demand the amount. If the other party do not agree, file a case against them.

Ask her to see both estimates before paying anything. Sounds like she is just trying to get more money. Next time take pics if you have one handy or call the police. Not everyone is as honest as you may be. Years ago, I backed into a car, left only a scratch or two. Didnt want to go through insurance or call the police because I didnt want it on my record. Told the lady to get an estimate and call me. She did. I asked to see the estimate offered to meet her somewhere. She said she'd call me back and I never heard from her again. Now, I have a camara phones if Im in that situation again... or call the police. Next: The only info you should give is Insurance not personal info like drivers license number. Also, I worked in insurance before. you dont legally have to use the money to fix the car but Insurance companies keep damage on record so you cant reoprt it more once. Also, sometimes even a scratch could mean replacing the whole bumper depending on the type of car.

I think you do need three estimate if you want to take them to court, and from the look of it, that is the only way you can get your money without the run around they are giving you. Before you do that, give them a set time to pay up, or you will take them to court. Get three estimate, and the judge will pick the lowest estimate. It doesn't mean you should settle with a second rate shop, it only means you will have the choice who will work on your car. Keep the ball in your court, and show her parents that they can't mess around with you or your car. Good Luck.

Well to late to say you shouldn't have moved your car. But since you went to the Police Station to file an accident report was the girl sited for hitting your car?

There should be a court date unless YOU agreed to settle with the girls insurance company for "out of court" damages. If that is the case then YES, generally 3 quotes are necessary to establish a general and/or basic cost of repair. This is done to avoid things like "self repair; poor business practices or high-end shops.

If the other car was insured then the insurance companies will determine what company will do the repairs. It won't be up to the girls parents!

I would turn the accident report into YOUR insurance company for "claims" then allow them to do what you pay them premiums for!

Turn the information over to your insurance company. They will most likely recover the loss from the girl's insurance..

You do not have to get the car fixed at any place you don't want to so thus you only need one estimate.

Do you have full coverage or just liability on the other guy. If full coverage the insurance company should handle this. Your insurance co. should pay to fix your car and then bill and fight it out with her insurance co. It sounds to me as if they don't have insurance. For an insurance co. to pay you usually need two estimates. I do not think they have notified their insurance co. Take them to small claims court.

no it is not hit and run, since you got the name and number of the perosn who did it ( you should not have drove to the station but should have called the police and had them come to the scene and question the girl

Who cares if the girl is upset and wants to leave

You don't have to get any estimates, you get the car fixed and give them the bill, if they don't pay you sue them in court.

Turn this around. If you had hit her, wouldn't you want more than one estimate to be sure you weren't paying more than necessary? Don't you comparison shop for large items?
