For example, my local nfl team are known as the Cincinnati Bengals and have trademarked the name "Who Dey". I own the website bengalswhodey.com, I just filled out my form to register the business name "Bengals Who Dey" I should get accepted to own this correct? I already found out the business name was available.

You're going to want to consult with a trademark attorney. If the NFL has trademarked the name Cincinnati Bengals AND Who Dey...basically, what you're using is just a variation off of 2 marks that you don't really own. Obtaining the domain name does not translate to having the legal rights to the name. Again, consult with an attorney before delving deeper into this.

Hope that helps!

Just because the business name is available with the Secretary of State's office, does not mean you have the rights in the name. I would not be surprised if you didn't hear from the Bengal's or NFL's attorneys, fan or not.
