The are mandatory at every level, unless you are being paid. In other words, professionals (minors as well) do not have to wear them.

When I was a kid, helmets where mandatory but mouth guards weren't. It was our decision if we wanted it or not. Now @ 2006, I don't know. I would suggest going to the Hockey association to find out.

I would be very surprised if there was a league anywhere outside the NHL that had it as optional (and most NHL players where them as well)
