I have neighbor who cooks the most annoying food, all the time, and lets his charcoals burn unattended. I've notified my apartment management company, but they really suck, and said we can pay to move to a different apartment.

You may check local ordinances and report to the local fire marshal if the "neighbor" continues to do that. Common sense would dictate that this is an unsafe activity. Too bad the complex management is ignoring the situation. Document the effort to report the fire hazard to management in the potential event there is a fire, you may have grounds to sue the complex for negligence aside from the insurance claim.

Sometimes a letter from an attorney will get action. If you contact the apartment owner and report the inaction of the manager to take steps to protect their assets I assure you they will take action- both to relieve the current manager and the thrill by fire hazard seeking neighbor.

There are worse things that can happen than lose an idiot neighbor.

You don't want to live in an apartment, you want to purchase a house. You will always have neighbors in your complex doing things that you don't like and the management company will not take any action against.

I can help you purchase a house then you will not be concerned with your cook annoying food. You will not be putting up with those stupid management companies nor those neighbors that cook annoying food.

Of course if you purchase a house and your next door neighbor allows his coal to go out, I don't know what you would do.

Most apartment managers think that BBQ ing is normal especially in California the Golden State, so their heart is not into sending letters to individuals that BBQ, right or wrong that is the sentiment.

If it is stated in your lease that the use of charcoal bbq in your patio area of you apartment. That is a violation of the lease and you can point it out to the manager. Also you can contact the owner of the complex and let him know that the manager is not following the lease and breaking the rules of this lease. It is also a fire hazard and you can call the fire department every time he leaves it and the appartment company gets billed for it and that man might be kicked out of the complex for not complying to the rules. Keep notes of all the times this has happened. Let the neighbor know he is breaking the rules and note that down also. Dates times what he says reactions of all parties. Enough complaints will make the owner start thinking about what is going on with this bad tenant and remove him from the appartment for the breach of contract with them.

Also you can go to your public library and check out the books on fire laws. Or call the fire department. T

Most cities have an ordinance that prohibits the use of a bbq grill within so many feet (usually 10) of an apartment overhang. So you should call the non emergency number to the fire department and report them. Tell them you think they are going to burn the place down, and they will come right over and write them a ticket.

There is no law regarding BBQs and I see no issues with what your neighbor is doing. As to the person stating that the HOA stated that they cannot have BBQs on the porch, I don'tthink they have a legal right to put that in their CC&Rs.

It is illegal, I bought a new condominium a year and a half ago, and in our last HOA meetings it was discussed that anyone who had a BBQ grill must not have it on any of the 4 balconies as it is a fire hazard and it is prohibited, you need to notify the fire department.

Call the fire dept. The fumes from charcoal are toxic and it is a fire hazard to use a BBQ on a deck.
