i booked a 2 day shared course in driving lesson`s , then 1 week before my course was supposed to start the company rang me at 5pm with a cancellation saying that i needed to be in blackpool for the start of the course before 9 am the next day , i travelled through the night to arrive at blackpool at 7 am ! when i got to the b&b the landlady had to got to 4 different b&bs to find me a room as they were fully booked ! the instructor turned up at 9.30 am and picked up another learner before me , we then went on our lesson ! in the time beetween 9.30am and 3pm i did a total of 90 minutes driving ! we then finished for the day ! the next morning ( my test day) i was picked up and told my test was 30 miles away in chorley , i had a total of 20 minutes driving before my test , ( i passed ) the amount for the shared course was £245 but because of the amount of time i had behind the wheel i stopped the cheque , they are now taking me to court ! any suggestions what i should do? they`re wrong

because it was supposed to be a 10 hour shared coarse . i only stayed in the b&b for 1 night and had no meals etc , my test was supposed to be in blackpool not 30 miles away , my gripe is , if it was a cancellation then why did the company have to , find me a b&b ,then have to get me a test in chorley ( i was told when they rang it would be in blackpool ) if it was a cancellation then it was already booked ! this was a total farce from start to finish , i am willing to pay something for the coarse but i don`t see why i should have to pay the ull amount as i was only there for part of it , and the amount i had behind the wheel was less than 5 hour`s .

When you booked the course did it say how long you would get actual driving and how long theory.Overall it seems like a bad idea,and not properly organised you need to write to them and explain why you stopped the cheque as when it goes to court you will also have court costs .

Just pay up.
You passed
All you got to do now is learn to drive, because no matter how many hours tuition you have it is only when the safety blanket of an experienced instructor in the next seat is taken away that you start to learn, possibly the hard way, try an emergency stop from 70 on a deserted dual carriageway and try 30 round a wet roundabout when there is no traffic about and practice correcting slides.
Plenty of people pay £1000 or more for a license, especially the illiterate and some people make a good living taking tests on behalf of others, at £ 500 or more a throw.
You got off light so just pay up before the Lawyers fees get added.

I would go to the Citizens advice bureau and see one of their legal advisers to see if you have a case. Hey that wasn't bad though less than 2 hours driving and you passed your test congratulations.
Have you written your complaint to them and explained that 110mins total time behind the wheel wasn't enough for the amount you were charged.?
Did they tell you how much driving time you should expect to receive when you booked the course?
It might be worth offering them a reduced sum of money such as half to two thirds of the course fee and see if they will settle for that.
Lets face it you did pass and it wil have cost you alot less than a lot of people.

it is fair enough you did not get what you were supposed to, i too would be annoyed, however, you cant just stop the cheque. it should have been bought to them as a grievance and you ask for the amount of money back, then if they do not refund it to the appropraite amount you can taken them to court. unfortunately as you have stopped the cheque they are within their rights to take you to court. although paying and then disputing seems unfair (which it is) at least you have never been in the wrong and that stands in your favour,

You need to review your agreement or contract. If it states that you would receive a specific amount of driving time and you document that you did not, then it is your word against theirs. (Hopefully you have the names of the others students or can get them so they can corroborate your version.) Otherwise, if they only state that you would pass the test and you passed it, then you had better try to settle out of court.

amend the cheque to the ammount you think, but seeing as you did past the test parhaps they deserve the full ammount

You passed didn't you-so just put it down to experience and move on...life is too short,just DRIVE!!
