The main question I would have before answering your question is; "Does the woodstove share the same flue or pipe as the oil furnace or just the same chimney structure?" If they only share the same structure and not the same flue, that is not a code violation. If they share the same flue, it is a code violation. The problem with sharing flues is that you never know when it will mess up and vent the oil furnace or woodstove out the other unit and cause troubles or even worse. Just because it worked ok before does not make it safe. If you are not sure if they have their own separate flues, you should contact a professional to inspect the system for you. codes require a seperate chimney for each the furnace and woodstove. When I was growing up the house had both on one chimney and never had any problems.
