I am not sure what the laws are in the state you live in, but, in New York state it is soley based on his income...your income should not even come into the picture. That is not his money to support his kids with. It is yours. On this note: I am on the end that deals with a deadbeat dad, all I ask is to help the kids. I think a true father should have no problem providing for his kids no matter what he has to do. I hopes this is the case for your hubby to be. Good luck..pssstt..I would fight if they (court) wanted to include your money in toward his income.

Unfortunately;yes. She would have to file what is called a support modification. If she thinks she is not getting enough money from him and can prove she has a substantial increse in caretaking she can with the help of the court, go after you as well. This is not very hard to do. She can claim she wants him/her in a 4k a year private institution. the court will serriously consider it. She can claim the cost of where she lives has become more expensive. She can do this every year as well if she thinks he has gotten a salery increse or came into a great deal of money at one time. The system is set up to make it very difficult for a male to recover from such hardships and less attractive to a prespective mate. It doesn't stop there. The OCE go after his drivers license his credit rating etc.. Now I am not saying that the office of child support is not just in a lot of it's cases;but it has afforded women an unfair advantage in an adversarial situation. Sad to say, you have to be careful with whom you spend your time. Marrage is beautiful thing to the right person. I am by no means trying to discurrage you. All I am saying is it will take the both of you to endure what may come.

tough question depends on what state you live in, I really don't think so. I think if the courts ordered him to pay a certain amount it won't change. the baby is not your blood. I never was able to get my kids dads wife to pay child support out of her wages not her bag of responsibilities. Call legal services, might get the right answerer there

I think it is just based on his income, not yours. You could check with the county the mother lives in and ask to make sure.

I believe the law varies by state and possibly by county. you should check the law for the county she lives in and you live in, if they are different.
