If it isn't covered in the collective agreement (union contract), and they choose not to involve the union in the matter, then 'yes' they can discipline an employee. If the situation occurs on company property, they may even call the police and have the employee arrested.
I would be very surprised that a company that has both a collective agreement and a formal drug testing policy wouldn't have the agreement of the union as to what happens when someone fails it!
As well, drug policies often come with a set of prescribed procedures. Flagrant violations (dealing drugs on the premises, for instance) are commonly dealt with by firing the person involved. For less serious matters the policy may prescribe counselling. The situation dictates.
The cost of employees taking drugs is not one, I believe, that should be borne just by the employer. Illegal activities outside of the workplace that affect the employee's ability to perform their job should bear consequences for the drug-taker as well. Sorry.

As long as the company states they are a drug free environment then why couldn't they. A union protects workers rights. Doing drugs is not a right unless you have a medical reason. So don't really see what the union would have to do with this issue.

Usually these things are spelled out in the Union Contract. If it is not in the contract at all then it will be up to the discretion of the company.

It's a legal issue for them if you are using drugs, especially if someone gets hurt. The Union has no say in it.
