living together for 10 years and she decided to go back to her country with my 2 kids. what shall i do? I notice she is in love with somebody else in her country since her last vacation a year ago.

There is a legal inter-country treaty called the Hague Convention which protects spouses from removing the children from one country that has signed the treaty to another country. A spouse who unilaterally does this can be charged with child abduction under the Hague Convention. The US is a signatory country. Be sure you never agree verbally, and certainly in writing, to her removing the children, and definitely seek legal advice. You might want to go to an immigration attorney and explain your situation. Essentially, she has kidnapped your children, so you probably should notify the F.B.I. who has jurisdiction over kidnapping cases. There is precedent for this (where a spouse leaves the country with the kids) and where the father was able to have them returned. There is also international law affecting this kidnapping, not to mention the custody laws in her native country. But getting law enforcement involved is a first important step. Good luck!

From experience this is nothing to do with immigration lawyers
when you file for your divorce you need to ask for custody for your children or make some sort of arrangment with your wife (X)
I will tell you try to make arrangement with her, her country might be the best place to raise the children and not the US with a single father-- If you should decide to let her have custody make sure you are 100% involve have them flyin for every holiday
arrange that the ticket for coming to you is pay by you and the return to her is pay by her
in another word make this work out financially for both of you and put the needs of the children first

You might want to check with an attorney asap. From my understanding, the kids can't get a passport unless the father signs a statement allowing it. But check.

i am from another country,and my kids are US citizen.To get passport for my kids,they wanted both parents.So i really don't know what she did.But if she don't have dual citizenship for the kids,theres no way that they can stay in her country long.my husband wants to take our kids back to our country and i won't let him.You're the father of those kids.Stand up and get them back,no other man will take care of ur kids like u will.I'm sry for that,but get them back,and good luck.

Since they were born here, your children aren't citizens of her 'home country'. You DO have legal right for keeping them here. Ask an attorney.

check immigration or immigration lawyers in your area.

the child should not have a passport without your authorization.
if they dont need a passport, you may get government invlved to bring them back to the states - since they're not legals residents of the country she whisked them off too.

wow, That is harsh, get in contact with her family and find out where she went and try to get in contact with her to find out what is going on and to find out when you can see your kids, dude I am sorry

buy law shy cant stop her by the courts,if she does they can get her for kidnapping
