And why does the tax code favor unmarried couples when both work?

It's a double standard.

Strictly from a tax perspective, getting married makes the most sense when one spouse earns income and the other spouse doesn't earn income. That because one income is being spread over two people, and the income is now tax at the more favorable Married Filing Joint tax rates, and the married couple can enjoy higher limitations on retirement savings and other tax benefits. Again, strictly from a tax perspective, staying single makes the most sense when both life-partners earn income.

I just typed out an an answer to this question, but it was long an non-sensical. It isn't "fair". It is a double standard. Still an American could not be able to afford kids and a house and the daycare, etc. without these "unfair" tax breaks. "Scale" it is the same, bottom line its not, unless you can claim head of household, which you can only do if you have kids. Ultimately the reason is this: you pay less taxes, but you're still paying more out for living expenses. (Is this still non-sensical. lol)

The exception is when women have children and leave the workplace.

I have been married for years and never felt like I was getting a special break.

Not sure I agree with your premise.

Can you give a specific example of the unfairnesses you mention, so that I can give you a better answer?
