If they haven't signed a lease, then they have no right to be there, they are not tennants, they are trespassers. Call the police and get them out.

All answers calling these people "squatters" or "trespassers" are correct. Someone cannot be a "tenant" if there wasn't a lease signed. You will have to go and speak with the local Sheriff to find out what they need to serve the people with formal eviction papers. This is not the only issue you have, however.

Since these people have already shown themselves to be uncooperative, don't expect that they will move out gracefully. Make sure you have some way of identifying them - names, social security numbers, vehicle information - to enable you to pursue legal action against them for any damage they may do to your property, out of vindictiveness over being evicted.

Sorry to say it, but, all of this could have been avoided if you had taken the steps to protect your interests up front. Your property represents a sizeable investment. Next time, do it by the book.

Partly depends if you've taken any money as rent. Either way I'd take them to court and get an eviction notice as quick as possible. The longer you leave it the more 'assumed rights' they will claim. Any verbal agreement can be denied from both sides (but you have the harder case to prove otherwise why give them the keys if you had no agreement ?)

Today the won't sign the lease what's next on the agenda rent ? damage to the property, selling off 'unwanted assets' ?

You really should get it all signed up prior to giving over any keys.

If they have moved in without signing a lease, In some states that could be considered trespassing. I would just go down and file an Eviction. Make sure you give notice to the residents first

In most states, they have 30 days without a lease. I suggest you go to Court and get a legal eviction order before they ruin the house. The next time you rent out a unit, NEVER allow anyone in the propery with out a lease, even family.

If they have refused to sign the lease, essentially the are tresspassing, call the police. File a report, and give them 15 days to vacate the property, or you will place a padlock on the door and have their property removed for them. Hopefully you did remember to get the security deposit!

If you didn't give permission for them to move in then they are squatters and you can file criminal tresspass charges against them. To bad it's only a misdemenor. If you gave them implied permission (verbal agreement, handshake) and then they moved in and now refuse to sign you have to evict them. And depending on how long they've been there and the laws in your state, it could take months to get them legally out of your property. Best of Luck!!!

You should have got them to sign the lease beforehand you Muppet!! Anyway you threaten them with legal action but if you do you have to carry that out and have them evicted but you also need to prove that you own the property

I'm no expert, but I would tell them to leave and if they don't, call the police. If they haven't signed the lease then technically, they are not tennants.

Did you have a verbal agreement on what the rent amount was? Check with your local Housing Authority to see what they say.
