Indy T ALMOST got it right.
As per the Lawrence vs. Texas case, the Supreme Court did abolish ALL sodomy laws on the national level.
Unfortunately there is ONE state that has continued to IGNORE this ruling, Virginia.
Their argument is that they are not a "state" but a Commonwealth and therefore the Supreme Court Ruling has no jurisdiction in their Commonwealth.
Although no case has been prosecuted in that "state" regarding the Federal Sodomy laws.
Only ONE state allows legalized "Gay Marriage" and that state is Mass. BUT, and this is important, ONLY residents of the state of Mass and Rhode Island are allowed to participate...AND no other state recognizes these "marriages" as legally binding.
This also includes the Federal Level as well.
As a nation, our country does not recognize Gay Marriages from other countries, nor same sex fiance's...so spousal and fiance' visas for same sex partners are NOT granted.
Here's a PDF file that shows, State By State, what Gay rights are across the nation.

chris c needs to read updated lawbooks. as of 1973, the american psychiatric association removed sexuality from the list of illnesses, mental or otherwise. it is illegal for doctors to diagnose any sexuality as a sickness or disease or give therapy to convert this. this was brought up by the fact that nobody can prove that it is a choice or genetic. this also had part with the fact that so-called "conversion therapy" caused a lot of suicides. the rest of most of the people are right though that sodomy and oral sex is illegal in some states. also, some sex positions are illegal in some areas. the military also lists oral and anal sex as illegal. who could prove this and enforce/prosecute unless it was happening in public? what u do in the privacy of your own home is your business.

It's not illegal to be gay in the U.S. However, many rights that is common for a heterosexual couple are non-existant for gay couples. This includes marriage, health benefits, hospital visits and etc.

If you want to get married and you are gay, you would have to go to Canada and they will marry you there.
Canadian same-sex marriage expected to survive challenge
Gay people apparently have little to fear this fall when Canadian Prime Minister Stephen Harper engineers a promised vote in Parliament to determine if MPs want to undo Canada’s legalization of same-sex marriage.
For one thing, the Bloc Québécois and New Democratic parties have promised that all their members—who total 79 of the 308 in the House of Commons—will oppose the move.
And more than enough members of the Liberal and Conservative parties seem to feel that reopening the matter is not the best way to spend their time and energy.
The vote is expected to favor gays more strongly than the 158-133 vote on June 28, 2005, that legalized gay marriage in the first place.

To be gay, as such, no, that is preference not an act. It's not illegal to be a pedophile as long as you don't act on it. To engage in non-procreative sexual activity, as in oral or anal sex, hetero or homo, even between a husband and wife, or any form of bestiality, is illegal in most states as well as for all members of the armed forces.

In some states it is against the law for two people of the same sex to have sex with each other. Then again some states don't allow anal or oralsex at all (including straight couples). In Florida it is actually against the law for married couples to have sex in any other position then missionary style. It's not like those laws get followed. Of course those laws are very old too so not enforced as far as I know of anyways.
