This was about a month ago, have been calling dentist every day since then, trying to get her to correct the problem, she says the soonest she will be able to get to me again is in December, she's already been paid for this service, I cannot afford to pay another dentist, what legal action can I take?

Tell her you will report her to the board of dentistry. This is outrageous. Then I would go to the office and demand to be seen. This is an emergency. Never go to that dentist again. And yes, I really would report her.

A filling falling out would fall under an emergency. Call her office, point out that she has already been paid for service that wasn't up to par, and if she can't fit you into one of the emergency slots, that you will have to contact and attorney. Then call legal aid. I believe you would be able to sue for the cost that you paid to her for the service and the cost of having another dentist redo the work. Most court houses have a court advocate, that can advise you on paperwork, ask for paperwork to fill a small claims suit. Then call and get a quote from 3 different dentist as to the cost of repair. Add them together divide by 3 and ask the court to award you that amount to pay for another dentist and the cost of her fee, as well as all court costs

You should have walked into her office and asked in front of people that she correct the situation. Calmly. I doubt she would have wanted to look bad in front of people about to be treated.

You are kinda screwed now. You let it go for so long that you really don't have much proof it happened that same day so court is an option but probably a losing one. You will probably just have to pay a new dentist. I would anyway, I certainly wouldn't go back to her now.

I don't think much of your dentist, even if she does claim to be that busy. A missing or cracked filling is an invitation for tooth decay, so the dentist should fix it ASAP. Last time I had a cracked filling I had it fixed within two weeks.

I would DEMAND an appointment immediately. The longer you wait the worst the tooth will become. The dentist should NOT charge you to correct their mistake. If they refuse to help you...you will probably have to go to someone else....but I would take the other dentist to small claims court...you can file claims in small claims yourself and you will not require a lawyer.
Good luck....nothing hurts like a bad toothache.

I'm not sure of the name or brand of the temporary filling cement, but I do know that Wal-Mart carries one that is located near the toothbrush and toothpaste isle near the dental floss. The one that my husband used after his filling fell out came in a very small, round container. However, the type that he bought was also temporary and kept falling out as well. Good luck!

Tell the hag you're taking her to court! Report her to your State Consumers Affairs and whoever handles licensing of the dentists in your state!!!!

Talk with her friendly if she could put a temporal filling first as soon as possible. Legal actions are costly both in time and money, it is best to avoid as much as possible.

hope yur not in Phoenix!!the dr. we had, she went there!!and all the stuff she did fell out of my and a friends teeth! everybody in the small town we live in will tell yu horror storys!!I think the dental board made her leave the state?

Might not b any because she didn't refuse u serves u just have to wait and u might have just had a temp. in and u might have mis understood the Doc.Then that will have been ur misstake so take ur time first.
