i've been noticing that if someone has sex with a step-sibling it's incest but if someone's having sex with an in-law(ie sister inlaw,brother inlaw, etc.) it isn't. why the difference? why can't having sex with an inlaw be called incest too?

Well, it is considered incest but there are no criminal charges for it if we are talking about inlaws etc. The purpose of the law is to protect youngsters from the sexual abuse of parents, but when it comes to consenting adults who know and understand what they are doing, then I guess they can do whatever they want.

Incest it self is considered more of a social crime, rather than against the law. In certain societies it is perfectly fine, in others cousins can and do get married. It is a very relative norm that can be highly debated. I guess what really matters is protecting children.
