There is no legal basis for anyone to restrict access to space to anyone. In fact, there's plenty of precedent to say no one has any such jurisdiction, as several countries have satellites that pass or sit stationary over other countries.
So my answer is that it ain't nobody's business.

Yes, as soon as we are able, we need to establish the new UN headquarters on Mars.
Individual countries should have the authority to do so. One reason is that any country that is able to colonize the moon or a planet will also pay for the whol endeavor, and we know which is the only country which will be able to do that, namely the USA, If we pay for the construction of moonbases or Marsbases, why the hell should the UN have any say over what we do? Money talks, and BS walks.

The UN can't even get out of its own way, much less manage the colonization of other planets. Hopefully, by the time that becomes an issue the UN will be disbanded and replaced with an effective administration.

Is the UN allowed to function properly in this world, settled on the Earth? Most see it as an obstacle..Do u think nations r gng 2 care for UN when they spot life on a planet apart from earth?! I dnt think so..

I shouldn't laugh, maybe it's not as far off in time as I think. Anyway it looks like that might be one of the few things that we might get right. The new space station is a multi-country undertaking.
