if a game has an error and the games maker games out with a patch and I buy the game after they made the patch will the patch be on the cd?

no, you have to go to the website and download the patch. either the site of the company that made the game, or a website like Fileplanet.com

Not likely - you would have to download the patch from the game maker's website in most cases, unless, you are buying a game, then buy an expansion pack - the ep would have on it any needed patches. But it's always good to check what version of the game you have.
