reset it by switching the hold switch from on and then off. and then hold the menu button and the center button tolgether for about 6 seconds. this will reset your ipod, but it won't delete all your songs.
try also plugging it into your computer or etc.
my ipod is having problems these couple of days too..it sucks!

It depends on how long you've had it. If it freezes in the first week you've had it, yeah, get a replacement if possible, if you've had it for more than a year, you probably can't get a replacement, not on the basic warranty anyway.
Manufacturers warranty is usually one year, parts and labour, which will not cover complete replacement. They would probably service it, which, for all we know, could simply involve restoring it and ignoring, hoping it wont happen again, but would take 3 weeks.

make sure the hold switch isn't stuck on. If it's a 3g ipod, move the hold switch on, then squeezing *firmly* from the SIDE edges, turn the hold switch to off.
otherwise, try the resetting by switching hold on then off, then holding menu and the select button for at least 5 seconds. If all else fails, try a restore. iPods occasionally have hiccups. it's nothing to worry about.

Find your hold switch, switch it on, then off, and then hold down your menu button (found on the top of your click wheel) and the center button (in the center of your click wheel) until the screen goes blank and the Apple logo pops up.
