his insurancs co says only has insure for truck not farm and its a working farm with alot of equipment,(have lawyer )any suggestions? How much should i sue for ? Month off work still in pain 18,ooo bike and 15, 000 meds its been a year and im feeling anxious

Dude, I feel your pain. I lost out on a military career due to a dipstick pulling in front of me on my bike. The only thing that saved me was I was on post, and returning from my dtuy station. I don't know if I would try to get all his stuff if you could not work it, or keep the hired hands on it. You may end up with no clothes after the big lawsuit, having to take over the business. If you can handle the biz, go for the big one. Motorcycle riders are people too! (99 FXDWG w/ the TC88!) More power to you Bro!

Well... it really depends on the state you're in... some states have a "Personal Injury Protection" clause in their insurance policies... and the way they interpret them for motorcycles is different than for cars.

Their argument is going to be that you were going too fast for the range of your headlight (one of those basic Rider Safety Course informationals). Depending on the speed you were going, you argument may not stand up in legal proceedings.

A good Personal Injury lawyer is going to be your best option, but keep in mind there is probably going to be a limit to the amount of $$ you can try to recoup. Your tangible losses (cost to repair the bike, medical bills, lost wages) are going to be much easier to prove than the old "pain and suffering" plea.

so you ran into a hay wagon? the tractor would have lights and usaully there is a reflective triangle on the back of wagons.
