A friend's lease ends Oct. 31st, her husband just returned from Iraq and is stationed in Washington where she will be moving. Is the 60-day notice required by her contract if she does not want to renew even enforceable here in TX? If she gives notice of intent to leave now, will she be held responsible for 30 days past next rent due date, or just 30 days past date of notice (per SSCRA)? Thanks in advance!

Since your lease states 60 days, then that is the required notice.

However, TX law does grant exceptions for military personnel and their dependents. The notice requirement is 30 days following the next rent payment due date. That's potentially a bit longer than the SSCRA 30 day notice, but the SSCRA notice does not apply to military personnel who were on extended active duty when they signed the lease. Nor does it apply to dependents if the military member did not sign the lease.

Scroll down to § 92.017. It's all spelled out clearly there.

a million. specific the clause is very specific. You had to furnish thirty days written word previous to the expiration or it could renew. seems very sparkling to me. 2. the owner did provide you notice....that is call your hire. Did you examine it till now you signed?
