The driver was in the legal limit for alchol. She has previously been charged with driivng witout a license and has gotten a slap on the wrist. The driver is trying to blame the victim for the accident. I am just trying to get some sort of by the book penalties. Just as a reference.

She'll probably get a fine for the driving without a license but she could be charged with anything from reckless endangerment to manslaughter for the victim's death.

If no other crime was committed, then there is no "penalty" for killing the passenger. If she had been driving in an unsafe way, that could be reckless endangerment. As driving without a license was her only crime (regardless of what happened), then the only sentence she could get is for not having a license.

I believe the only way to "penalize" her for the death of the passenger would be under wrongful death in civil court.
