if there is a custudy battle of a baby that is not even born yet between a newly married couple, for three months and cant even get along, husband is still living with mother, but yet wife is a mother of a 7 year old son that he shows no intrest to or shows no intrest in new baby, he wants full custady because he feels the wife is un fit to be the mother of his child but he thinks a 8pm bedtime for a seven year old is not right he thinks it is okay for the child to do whatever he or she wants , also he thinks its okay to not wear a seatbelt in the car and even if it is in the back seat. im not sure what to do i really dont think he should even fight me on this i dont want trouble on his part.

They usually NOT take a baby away from it's mother. They will probably issue joint custody, but while the baby is little, it will probably have to be with you most of the time. He will definetely get a visitation schedule that may include a couple of days with him, away from your home.
Just make sure you ask for a family restraining order which means neither of you can take the baby out of the county, or state. That way if you think he's a flight risk, and he DOES take the baby, they will get him, and they won't tell you that junk about there being nothing they can do since he is the biological father.

Just because YOU don't think he should fight you or because YOU don't want trouble on his part doesn't mean he can't. You've made it unclear the parentage of the 7 year old. If the 7 year old is not his then why should he show a lot of interest in the child? As for the new baby...well ummm the new baby isn't really a baby as yet. It's still a fetus and men don't relate well to fetuses. Since he is the father of this fetus he has ever legal right to fight you for custody. Frankly you both sound pretty immature to me.

He should not fight you on this but he will . He needs to move on and let this person do as they need to do with their child . Not wearing the seat belt is endangering the child . 8 pm seems to me is an acceptable bed time . He shows very little interest in a new baby is he crazy or just indifferent ? And this loser want s full custody ? Oh yeah that is really going to happen NOT . He thinks the wife is unfit ?,what makes him any better? god what a mess. Good Luck with this one.

This is a moot issue. Despite this childish and weak attempt to make it look as though one party is the evil one here the judge will order visitation rights and shared custody.
You're wasting your time. never should have gotten knocked up in the first place by a guy who still lives with his mother...that's rule #1 baby.

It would be up to the courts, he would have to prove her unfit and thats hard to do,the court would take hoe each is into consideration you should win.

girl he wont win. dont sweat it. courts keep kids with moms. they hate to split up that relationship. you can be a crack head and they still wont take your kid. stay strong. he will lose.
