I just wrote the last e-mail, about finding a rent check from last May. The renters are still in the house, from the answers I got the check may not be valid, but they still owe me for last May's rent--right?

Usually checks are good for 90 days. Go to the bank and ask them if they will cash it. Otherwise you will need to go to the renters with the old check, and have them right you a new check. They still owe you if that check is no good. They should know that it never cleared their bank. Why did it take you til October to find a May check? You probably should keep better records to prevent this from happening again.

yes they still owe you the rent. Technically they are behind.
It stinks for them but Its true.they will have to come up with 2 months rent next month or something. Maybe you can work something out like they pay Novembers rent on the 1st. plus pay 1/2 of mays
then on the 15th or so they can pay the other half. This is is they act like they cant pay it!

Until the check clears the bank and the money is in your account, they still owe you the rent. However, you need to actually attempt to cash the check before you can proceed with any remedies.

Unless the check has an expiration date, or they put a stop on the check, try depositing it. I have deposited checks that were older than 6 months successfully.

If you haven't been paid they owe it. You have a negotiable instrument and if it doesnt expire by a statement on the face of the check, it's good, assuming of course that they realize they have to make it good.

I answered that for you.

The check should still be ok to deposit, and if it bounces, you can take them to court for non-payment.

Just because you forgot to deposit it does not release them from their obligation to pay.

I find it odd that your tenants did not happen to notice that their rent check was never cashed. Are you sure your husband never got a replacement check from them?
