Your lawyer knows. There is a long and practiced procedure of public announcement, so if he doesn't respond then it essentially becomes an unchallenged divorce--you win.

Depending on what state you are, there is an amount of time that goes by and you can claim abandonment. You can get get a divorce without his permission. If you put in any search bar on the internet, Divorce Laws, you'll find out exactly the amount of time. I know most states are 1 year, Vermont is 7 years, Rhode Island is 5 years, North Carolina & Maine are 3 years, New Hampshire is 2 years. Every other state is 1 year or not applicable.

It depends on which state you live in. I know in Florida when I worked for a company that filed divorces, if you had been seperated 6 months and didn't know where your partner was, we would post it in the newspaper of the last town/city where you knew the person had been and post it on the bulliten board at the courthouse where we filed. If there was no response after 4 weeks you could go before the judge and have your divorce granted. It's usually not as hard as it sounds. Good luck!

kb has it right you can post the notice in the leagal notices part of the newspaper .......so long as there are not any childrens custody involved......if he does not answer your divorce will be granted you just have to show that you made a reasonable attempt to inform him of it......my friends husband divorced her and she didnt know about it for 2 yrs...i think you will need a lawyer to do this though........if you cant afford one go to free leagal aid and see if you qualify.

Go to your areal Legal Aid, it will cost a 100 bucks, they will file all the necessary paperwork, advertise the divorce to contact him, and if he dosent contact them,the divorce is granted free and clear.

Check your state laws to determine how long he has to be missing before you can file for divorce..
This is usually not much of a problem...

ON GROUNDS OF ABANDONMENT, YOU HAVE TO PUT A NOTICE IN YOUR LOCAL PAPER FOR A MONTH, IF KNOW RESPONSE, THE DIVORCE SHOULD GO THRU.
I THINK YOU HAVE TO HAVE A LAWYER.
