It depends on who they hire to do the back ground check, and how much they are willing to pay. Search the computer under back ground checks. You will find some investigative companies that come right out and say that they can find out any thing about anyone, no matter what privacy laws are in place.

No, but....Some companies run workman's comp history reports. These are mainly for manual labor jobs. It looks to see if you have ever filed a comp. claim, and the reports can sometimes include the reason for the claim. HOWEVER, a previous workman's comp. claim can NOT be used to deny you employment. Althought there are companies out there who will deny employment for this, the courts have ruled that filing a workers comp. claim in the past does not mean you are going to file one in the future. Plus, there are issues with medical records and the ADA (American with Disabilies Act) and discrimination against someone with a disability.

Your medical records are private. This is why they give you all of the HIPPA paperwork everytime you go the hospital. Your record cannot be released just because someone wants to see them. The governement has to be involved in your matter for the release of private medical records. If you were to file a claim for Workers Compensation due to an injury at your workplace, then you med records may be accessed for information clarafication purposes only.
