I got a mobile phone about 6 months ago.

It was faulty within the first wk, and i had to put it in to get fuxed.

It broke about 2 months ago, and the software had to be replaced

Today i tuned it on and the mike is broken and my ringtone is not playing even tho it is on full.

Do i have a right to ask fo a completely diff phone?

This is the 3rd time it has broke and i reply on the phone as i dont have a landline.

It depends on which provider you are with - the sales of good act stipulates that if the phone is faulty within the first 6 months it has to be replaced. If that fault occurs within the first 28 days then they replace it with a brand new replacement. if its faulty after 28 days but within 6 months its a reconditioned replacement. If the phone keeps breaking then most networks have in place what is called a "DMR Procedure" which is basically a different model replacement. But to qualify for this you have to have 3 faults of the SAME nature. So this means if you have had dodgy software, a dodgy screen and broken keys then you wont qualify. If however your screen has broken 3 times then you would qualify for the DMR. The network really holds no liability for the phone itself as your contract is for the provision of airtime and not the handset, that lies with ur manufacturers warranty and the company who make the phone

If you have insurance on the phone, maybe but usually the faults need to be the same, it depends on the terms of replacement of the network your using. They may can only replace it with another like for like replacement as its over six months. I would call them and ask for a replacement but of a different model because of the faulty equipent you have been provided since you became their customer.

You do if your phone has a warranty on it and if it's still under warranty. Also did you take out any insurance on it? When I got my cell they asked me if I wanted some insurance on it so in case something happens to it I could get it fixed or get a new one cheaper than having to replace it for the whole price. I am with Alltel and I pay about $6 extra a month and it came in handy when my husband lost his cell and when my flip phone's hinges broke. They replaced my phone for free with the same version and I only had to pay $50 to replace my husbands phone... if we hadn't had insurance he would have had to pay the full price to replace his phone.....$500!


If it's a prepaid phone they probably won't replace it.

You have the right to a new version of the same phone
contact your dealer/supplier and tell them you would like a replacement as the phone you have is obviously faulty beyond permanent repair

If you are in the UK you have rights under the Sale & Supply of Goods Act. See below for the detail but the goods have an implied warranty that they are fit for th epurpose for which they are sold. Then see the Citizens Advice Bureau.

I would have thought so, if you put your complaint in writing i think these companies are more inclined to act, and you may wanna remind your provider that in six months you will be able to choose a new provider. also check out the gov website to help you
