my home was hit by the city,s 20 ton grader in 2002, now i cannot accept the 12,000 they want to give me as it will not fix my house the way it was
a lot of damage, cracked basement, windows cracked, 2 fell off during the impact, torn lawn, separeted cupboards,veranda all but off , hanging there thats about it, cannot use my storm windows i had for years as they will not fit into the frame, had to leave my house for 6 months as i was having terrible nightmares from the accident, the city put me in a motel only to be put out 2 days later
had to come back home and wires were pulled from the main mask, had to wait till the hydro got a permit from the city for 5 days, not knowing if i was safe or not,to come and fix it at my cost
had a litigation lawyer, we tried to get into court to get this all settled , couldn,t seem to now he dissappeared or retired now we get a court date and i have to defend myself as the city will not fix my house, and i can,t take 12,000 knowing it will not fix

do loads of research and plan your case maticulously if you are going to defend yourself. the better prepared you are the better it will be. it sound to me as though you have pretty good grounds for demanding more money from the city, they'll be insured up to the hilt anyway.

Find out exactly how much the whole thing has cost you, repareing the house, having to move out etc and ask for that.

you should also write to the newspapers and tell your story, a bit of bad press won't do the city any favours and will stand you in better stead of getting a healthy out of court settlement and winning your case.

Whatever you are writing you give it to another suitable lawyer,Take photographs of the damage,Obtain quotation for therepairs.This should be sufficient proof and Court will award proper compensation

You'd have to go to court if a private party hit your home with a big machine and didn't offer you a suitable settlement. It's unfortunate that people don't understand what they owe and simply pay it but that's why we have courts.

File a case enumerating the actual costs of the damage.

I would have accepted the offer.
too much bother in fighting them for more.
