Two days ago I crashed into my neighbors car while I was driving in reverse getting out from my drive way.

My neighbor ALWAYS parks her car in front of her house but the back of her car sticks out and blocks part of my drive way.
I never said anything to her about it because I didn't want to cause any problems, so I just let it go and continued to get out of my driveway the wrong way (driving my car in reverse and turning onto the sidewalk to get out so I wouldn't hit her car).
Finally, two days ago, my very irresponsible neighbors let their little kids outside unattended AS USUAL and one of the little boys (around 4 years old) was on MY driveway behind my car playing. I didn't see him and almost hit him because he's small and is not supposed to be there! Anyway, after I yelled out the window and told him to get away, I was in shock because I almost hit him so I forgot about my neighbors car blocking the driveway and just drove down straight and hit it.

At first, she immediately said "no, no, stay in your car, it's no big deal" but I said "no, i have to see what damage was done".
So I got out of my car and she said "oh its nothing, it'll just be about 5-600 dollars worth of fixing and YOU will pay for it". After that, I freaked out. I was just like "WHAT? you block MY driveway and leave your children unnattended on MY property and I have to pay for the damage?"
She got mad and started talking about totally irrelevant things such as my family being loud in the morning, etc.
She also threatened to call the police, but I just told her "okay, call the police, stop threatening and live up to your words! If the police comes, they will just come to you with the 2006 california driver's manual and make you read the passage where it says 'do not block driveway'."
she got very mad and just got into her car and stormed off. We haven't talked since but i'm mad! I want her to pay for the damage!

Of course blocking a driveway is against the rules!

Do not tell me that parking right in front of someone's driveway blocking their entrance COMPLETELY is permitted! That's BS!

Simple answer. You're out of luck. I know you don't want to hear that, but you are. Since this happened on private property, there is nothing the police can do about it. Unless she is just willing and wanting to pay for it, there is nothing that can be done.

Unfortunately no matter what when you are in reverse you are always responsible. A parked car is never responsible for an accident. Kids playing in the driveway makes it even worse against you. I have been in the same boat with people driving down my street too fast but I was in reverse. Bottom line it's your fault and you will loose in court. You should have written her a note and you should have told her she is blocking your driveway. Not that it would make a difference if you hit her car. If you hit her kid it's worse but backing up you never have the right of way.
By the way if you called the cops they would have written a police report and sited you with a ticket. That's what happened to me. Be glad the police did not come. If no one was injured you don't need cops. Blocking a driveway is not against the law.Blocking an intersection is.

I am still concerned about the child playing in the Driveway, we are not allowed to block driveways or intersections here either, and though irritating at best, you could have mentioned this to her, being that you are living next to her, you should try to settle this quarrel out of court if only to maintain an relationship as a neighbor. If I was a judge listening to this story...I would think more about how much you were in "Shock" and still went about driving. If you do not have all your faculties about you, you should have waited until you had your faculties and wits so you could have stayed in control of your vehicle.

Ask a lawyer. I think you should of said something. it's your own fault for being *nice*

& I am so not trying to be mean. really. she was being rude by doing that but most people are rude & will get away with anything they think they can.

If the car is always there and you never complained it is your bad you pay the damage.

you should of called the cops and asked them. Ask your car insurance company and ask them the question
