I have just finished my job after working 2 weeks notice but as we left on bad terms my old employer (Arla Foods PLC) will not release my fork lift lisences or any certificates for courses that i attended (e.g. manual handling, fire safety, public speaking) whitch i took while with this employer. is there any way of getting them? the only other option i have is to pay for a re-test (about £260) for my flt license and then pay for the other courses.

Did you say 260 "pounds?" You must live in the U.K., so I'd have no idea what their labor laws are like there. In the U.S., I'm sure you could inspect your personnel file, and I don't think they could take your forklift license away from you unless your were randomly tested or had an accident and tested positive for alcohol or drugs while operating their equipment.

Although they could give you an unfavorable reference, I don't think they could take away any of the training certificates you earned while on the job. You may want to contact an attorney who specializes in labor law.

Good luck my friend, and I'm praying that you'll find something in your field and soon. Hang in there. Is there anyway you could patch things up with this employer?

Hi,

I believe you have the right under the data protection act to have access to information about you. The licences are yours so you should be able to get them back even if the company is awkward about it. Companies do generally play tough if they aren't too happy with employees. Do you have anything of theirs. If so, they may be holding this stuff back till you give back everything. I would go to the citizens advice bureau as they will know and also have the clout to do something about it.

Since you listed the cost of a retest in British pounds, I assume you live in England. I have no knowledge of English employment laws. I suggest you contact a barrister for some advice. In the good old U.S.A., we just sue the sh*it out of an employer who tries to withhold employment records. We have "Freedom of Information" laws in this country!
