I am a victim of Identity Theft, my credit card company told me to put a password on my account so the theif couldnt get in, I put one on the account and he is still accesing it three more times.

Well then change the damn password! If you set up an account and then didn't set a password, sue yourself as you're the negligent one.

No. Negligence is defined in the Restatement as "Conduct that falls below the standard of care established by law for the protection of others against the unreasonable risk of harm." Credit card companies usually take measures to protect individuals from identity theft. The fact that they recommended a password is evidence that the company is taking steps to keep your account secure.

Aside from that, I'm not aware of any credit card companies that have been sued for negligence where the plaintiff's cause of action was negligence.
