I've done a lot of research, but have failed to find an answer. How does a British man get to marry an American woman ?

If we get married in the UK, she has to have lived in the UK for a certain amount of time, which she couldn't really do without becoming an illegal immigrant. Same in reverse.

I may well be misunderstanding the law. It's not a strong point of mine.

It's not so much a problem with getting married, but with being able to stay together afterwards!

If you decide to get married in the US you apply for a K-1 fiance visa, or you can get married on a visa waiver, claim it was spur of the moment and then start sorting out paperwork - you'll probably have to go back to the UK while it's going through though, and immigration officers don't necessarily take too kindly to it.

If you get married in the UK I believe your wife will have to go back to the US to file for a visa to come to the UK. She should be able to stay here but she won't be eligible to work for a few years.

I am an American and my wife is Danish. She came to the US on a travel visa, we went to the courthouse and got married. This was only last year. Then we hired an immigration attorney and started the paperwork. As soon as we were married, she was allowed to stay in the US, but we were not allowed to leave the country until her travel documents arrived about 6 mos. later. She got her temporary work permission about the same time.
To answer your question, have the Brit come to the US to travel, then get married. The Brit may not be able to leave the US or work for about 6 months, but after that, he is home free. Just make sure to renew all the documents every year.
After about 18 months, you will have your interview with immigration to prove that the marriage is not a sham, and then the Brit will be able to have permanent residence here in the US. After five years, the Brit may apply for citizenship if he desires.
I don't know how it works in England, but my wife just got her permanent residence about a month ago.

It is true that Dept. of Homeland Security and INS are not as lenient as you might hope, but barring past criminal convictions and terrorist affiliations, you shouldn't have a hard time. It's just a matter of paperwork and money (about $3000)

You are definitely misunderstanding the law.
You can get married any time you like and where ever you like.
The process afterwards is a little drawn out, but not complicated.
It's a lot simpler if you enquire with an immigration lawyer. Or look on the British immigration web site.

Apply for a vias and a work permit. Once you have worked there for some time. It is not that difficult. I know someone who has been in a relatoinship with an American girl for the last few years and is getting married next year and will then move over there to live with her.

It may change from state to state.

No, seriously. A friend of mine has recently married an american lady. He went to the US and got a marriage license and had a local minister to carry out the ceremony. He's now back over here and finding it very difficult to get a visa to move there permanently. Would you believe he's 38 and had his visa application refused because he was caught by the police stealing a set of ladders when he was just 8!

Now we just keep asking him to come over and clean the upstairs windows.

It's not difficult in the US. Just go get a license and find a minister or judge to do it, and there you are. You work out the green card stuff with immigration after the fact.

While it is very easy and fast to get married in the U.S., don't even think about coming to the U.S. on a tourist visa with the intent of getting married. That is visa fraud. If you do and then apply to stay in the U.S. afterward, you will be denied and deported, and will probably be excluded from the U.S. for some number of years for committing visa fraud. If you want to do it legally, you must come to the U.S. on a fiance visa, which your girlfriend can apply for.
