not enough info, thats of course if you were in california. Everywhere else its not allowed which is a bummer cause lane sharing is where its at, filter thru to the head of traffic at lights cruise thru traffic jams instead of sitting there burning up. All states should pass this or at least ones I ride in.

A better description of the conditions and your speed vs. the car speed will allow people to give you good advice.
Some states and coutries allow lane splitting. Many do not.
Most places that allow it, do so with stringent requirements.
In California, you can lane split, but are not allowed to travel at a speed that is much greater than the cars you are passing. Ferinstance, if the cars are stopped, if you're whizzing past at 40 mph, then you would be at fault. If the cars are going 60mph, and you're doing 65, then you've got a stronger case against being at fault.
Any situation that puts you where no one expects you to be (lane splitting at 100mph when traffic is going 65 - darting in and out of lanes, etc) puts you at risk, and most likely at fault in an accident.

Sorry but splitting lanes would be your fault, so don't take this case to court because the lawyers would have a field day with you and the case.

You were definately at fault unless you were in CA because splitting lanes is illegal in all states except CA.
It's like if someone ran a red light and got hit by a car - running a red light is illegal so even though they were the ones who got hit, it is their fault.
If you were in CA, then I would need more info

As far as I know, California is the only state where splitting lanes is allowed... Who is at fault, is up to the insurance companies to fight over. If you have no insurance or liability only you have to take them to court.

if you are in California maybe it depends on other circumstances like were you exceeding the safe and prudent speed for conditions..next part of the answer if you weren't in California is YES because its against the law to split traffic...a word here even veteran drivers don't split traffic for a reason...
