I worked part time for a local gocery store in my town. I've been there for about 6 years. Acumilated vacation time and personal time. I got pregnant and couldn't work but maybe 4 to 8 hrs a week there. It wasn't under a doctor's notice. Anyways I had some complications with my pregnancy. Nobody told me to fill out paper for any maternity leave. After the baby I went about 6 weeks before I called them and asked them to put me back on the schedule. They told me that my job was terminated and that I would have to reapply. I asked why and told them about my vacation time that I had and I think I'm entitled to it. Well I called the corporate office and they told me I wasn't eligible for any time b/c I didn't average so many hours a months. I really couldn't. The District manager asked me why I didn't find out about the leave. I told him I was trying to have a baby and wasn't realy worried about my p/t job. Do you think they should pay me for my vac. time? I felt they violated me!

They terminated me and said I lost all my vacation time. That isn't right. I earned that with the 6 months of service. I'm not going back and I don't shop there either.

I'm not asking for my time back. All I want is the vacation pay I earned them six years. It's about 200.00 dollars is it even worth it?

See if you can get a copy of the Employee Handbook. That will give you an idea of what their policy is on maternity leave/vacation time. If it says you are entitled to it after quitting, then you should point it out to the company or notify a lawyer. If it seems unclear in the handbook, you might drop it by an lawyer's office to have them check it out. Because you signed on accepting the rules in the handbook, they have to honor it.

not all companies supply you with paid maternity leave... you would qualify for the vacation time if you put in for it... but if you don't have any serious paperwork following your story it could turn ugly in the sense that it will be one word vs. another. Maybe there is something that can be done about your company not offering to grant you a leave of absence in your situation but I'm not sure how far that would go either because it is half your responsibility to ask. Sorry I'm just telling you the way it is! It is what it is! Seeking legal advice may cost more money than its really worth... they may tell you that you have a strong case and then lose, but I wish you the best of luck all the same!

Unfotrtunately filing for maternity to leave was your responsibilty and you should have done that way before your due date. As a woman that is your right and they can't terminate you for that. But by those papers not filed they can terminate you for your absence. And gettig your time back is going to be impossible especially for you being neglegant in even contacting them.

they should have gave you the papers to fill out. thats where they messed up. if i was you i would talk to a lawyer and see what they say about it and go from there. i hope this helps and go luck.
