I returned to get something from my office after I left for the day and found my boss face down in my chair seat. I didn't say anything and left but I was obviously freaked out! I am looking for a new job but could this be considered sexual harrassment? A friend said it wouldn't be any different then if he thought about me while touching himself and that wouldn't be considered as sexual harrassment since it wouldn't affect me directly.

Your boss seems to be a flirty and funny old man. Well, I would advise you sure to get a new job.

Today he was sniffing your chair. Who knows! Tommorow he may make untoward advances towards you.

If he sniffs the chair while you're sitting in it, that would be sexual harassment. Also, you might consider the possibility that it's not just him. Maybe whenever you leave the office, everyone who works there lines up to sniff your chair. You ought to have an auction for people to bid on sniffing you instead of your chair. Or maybe you should get a sense of humor instead of taking yourself so seriously, you poor harassed creature.

You friend is correct--in order to be harassed, you need to be the object of the action, not the chair. At least we finally have a case where the boss has his nose up someone's * * * instead of the other way around.

I would say your boss is a freak! Do you belong to any kind of union or have any representation thru your employment? If not, look in the phonebook for somekind of legal aide. They can give the lowdown on the sexual harrassment & refer you somewhere. . I would also report it to his superior. That is just abnormal behavior. WEIRDO.

Unfortunately he could not be charged with sexual harassment but that doesn't mean that you do not feel victimized. I think that people do not know how it feels unless they have been victimized themselves. This must be a very awkward situation. His boss or HR may be interested in this info.

It isn't sexual harassment because you weren't actually physically involved and he -- evidently -- didn't know that he was being observed. But I'd get the heck outta there as soon as possible! This guy is too weird!
Good luck on your job hunt!

He could say he was investigating the source of potentially toxic smell or something. The point is, you are the only person who saw him and it's going to be your words against his. It's not worth mentioning to anybody. Just find a new job.

I don't really think you are harrassing him because although you gave him the opportunity, you didn't force him to sniff you chair. It may be cruel and unusual though, depending on your level of hygiene.
