The Ethics Committee can only investigate congressmen. Foley resigned so his case is in the hands of the FBI. The Ethics Committee is investigating who knew what and when (Dems and Republicans.)

After the election, of course. Actually there was no time to schedule anything earlier -- he resigned and the scandal came to light on the last day that Congress was in session before the elections.
