One husband has divorced his wife in UK according to muslim law. There after it has been revealed that the wife is pregnent. so it is clear that she has not been divorced till having birth. Now she wants to go for abortion. She has 8 weeks pregnancy. what is the legal and religious position of this case. should she go for abortion. what religion say and what uk law says .

I'm not sure about muslim law, but uk law says you can have an abortion up to 14 weeks. Abortion clinics will not question her religion and then say to her that she shouldn't terminate the pregnancy.

Assuming that the couple were legally married in the UK (Registry Office) then the Muslim divorce has no validity in a court of law. If the woman wanted to keep the child, then the father would be responsible for maintenance. (Unless he disputed fatherhood). The decision to abort is very difficult and should not be influenced by well-meaning friends and/or relations. She should take un-biased counselling. If the woman is over 18 and the husband makes no claims on the unborn child, then it's her decision. If the husband makes claims on the unborn child, then it is no longer a simple legal matter, but goes back to culture and religion. There are advice centres for Muslim Women in similar situations, but since I don't live in the UK, I'm unsure. Any Citizens' Advice Bureau in an area with a significant Muslim population should be able to provide addresses and/or telephone numbers.

I am not a muslim scholar. Seeing that there are no responses yet...

Before a divorce, there are certain conditions to see if a reconcilliation is possible such as not sharing the same bed.

After a divorce, there is a period of waiting to see if there is a child.

Abortions are not allowed as the soul is in the foetus after 40 days, unless the health of the mother is at risk.

My understanding may be wrong. so try asking a real scholar.

uk has no muslim law. if they married muslim law they were not married legally!!! so she has never been married. in all relagions abortion is sin.. but if she wants to get abortion she sure can
