Ok an ex friend of mine has threatened to report that I am with a man which makes me very happy, but yet I am still married because my husband refuses to give me a divorce, I have been having a difficult time trying to find a good way to get my divorce but not having any luck. could anyone please help me?

can they take away my kids because I am living with a man which is not my husband but is a father figure in my kids lives? we are very happy. I don't know why he is doing this to me we were friends until just recently. please help me

NO!!!! No one is going to take away your children because you are legally married and living with someone else. Tell your friend to mind her own buisness, besides if she were really your friend she would be happy for you and try to find a way to help you get your divorce!
First you need to contact legal aid in your state, they can help you find a lawyer at a reduced fee rate who may even offer you a monthly payment plan, get your divorce (if your ex doesn' t sign the judge can still order the divorce after a certain amount of time depending on your state) and continue to share your life w/ this wonderful sounding new man and children. But dump the so called friend.

You can file and get a divorce without his approval, it will just cost you a lot more money to get it.

As to the second part of the question, yes you can lose your children if you are living with another man that is not your husband and the father of the children has a problem with that. Most states have a law regarding paramour(s) which is boyfriends and girlfriends living in the same house as the children of separated/divorced parents. It does not matter how good he is to the children, if your husband that you are still legally married to can prove that you have another man living in the house with your children present, he can easily win custody of the children, regardless of what people on here tell you. States may vary on this, but I know it can happen, because I have full custody of my three children for that very reason. My ex shacked up with another guy while we were in the process of getting divorced and divorced and the judge granted me full custody of the children.

Well if your in the state of Florida there is no punishment for adultery (check your state laws on that) The best suggestion to get a divorce is hire a lawyer. He can not refuse anything that way. If you no longer want to stay married, you don't have to and he can not stop you.

If he refuses to sign the papers for the divorce from your attorney then be prepared to go to court.

No they will not take away your kids unless they can prove you've been an unfit mother...as long as you stay away from drugs alcohol, abusing children or have had family services in your home on more then a few occasions, you have no use getting alarmed.

Retain an attorney and file for the divorce. You can have a stipulation that requires your husband to pay for the divorce in full, so you will be out very little money.
