A local sheriff is being held in jail, for wearing his uniform & sidearm to a doctors appointment. His job requires him to be on duty 24/7. They said it was intemidateing. So if his job requires him to carry a firearm. Is it against the law in any state not to wear it in certian places?

State: Mississippi, A county sheriff, that has stepped on too many toes. Since taking office only a year ago he has made more arrest than any other in the last 40 years.

I carry mine with me every time I go to the doctors. In fact, I carry mine with me every time I go anywhere, except on an airplane. I could carry it there, too, if I really wanted, but the paperwork and hassle required beforehand would take a long time. And I do it in jeans and a t-shirt, if that's what I feel like wearing that day.

I am a police officer, and according to the Law Enforcement Officers Protection Act, also known as the National Right to Carry Act, that was signed into law by President Bush in 2004, I can legally carry my firearm with me anywhere in the United States, regardless of local concealed weapon policies, as long as I have my badge and police credentials with me.

So yes, I carry my firearm to a doctor's appointment. I have it concealed, though, so as not to draw extra attention to myself. Sometimes the most effective police officer is the one nobody knew was there. Once in the exam room, though, it's kinda hard to conceal it. The nurses and doctors notice, but I always make sure that my badge is visible if my weapon is visible. I've had quite a few conversations with doctors and nurses about it, and not one of them had a problem with a police officer having his weapon in their office.

For that officer to be in jail means that there was some criminal action that has been alleged and there was probable cause to substantiate it. There has to be more to this story than we know so far.

Sounds fishy, you sure there isn't more to it than that. In Arizona, it was recently declared by the sheriff that all Maricopa County officers are required to wear their sidearm at all times, on duty or off. However, it is also not illegal to carry a concealed weapon here as long as you have a permit. That is a recent law (last few years). Before that law was passed, you could only wear a firearm in public if it was clearly visible, so in small towns like Flagstaff you would see officers in plain clothes with pistols strapped on all the time.

General rule is any person licensed to carry a concelaed weapon can take them anywhere. There are exceptions and this will depend upon your partiucular state. For example in some states only police officers can have firearms on school property.

It is possible that your state prohibits anyone from carrying a concelaed weapon to a doctor's office. However, I doubt that it prohibits police officers from doing so. But, then again perhaps it only says on duty police officers.

You need to check your state law. I also think there may be more to the story than you have related.

I don't see a problem with an officer of the law taking his weapon into the doctor's office. What if the physician suffered an armed robbery by drug seeking criminals? I bet the doc would have been happy to see the sheriff armed and ready. I have a concealed carry permit and know of no such law in my state which would prevent me from taking my weapon into a doctor's office. Those who were "intimidated" should have had 3 armed robberies, as I have had...an officer with a gun would be a comfort.

In the US, the laws regarding this are by state, while in Canada, federally.

In most cases, police officers are like soldiers, the are expected to be available 24/7.

One point, many criminals and serious crimes have been dealt with by off-duty cops.

Depends on the State. Here in Michigan ex law enforcement with a CPL can carry their pistols in schools, casinos, bars, arena's and HOSPITALS. (places where normal CPL permits wont allow carrying a pistol)

So I'm sure that an on-duty officer would be allowed to carry in these places. (open or not)

If I had to guess there are some missing details to the story.

You want us to look up the law regarding law enforcement officers wearing firearms in ALL 50 STATES?

Generally, you can not bare arms in a court building or congressional office. For that you have to ne employed by that office. Police do have to take their guns off for that. As for hospitals, police are in fact allowed to carry their weapons with them. It is not a violation of the law to do so. In fact if their guns get stolen from their squad car they will get in trouble for that happening.

what state? That doesn't make sense at all. hello, every state has the 2nd amendment right? which I would assume falls into a category of concealed weapons, which he may need a permit for... BUT if he wore this with his uniform, obviously it wasn't concealed... that doesn't make sense at all.
