We are living in a 2 bedroom apartment in a college town. Our landlord said that since the apartment is recked then she is going to evict us. The apartment is dirty but far from recked, there are no damages to it. We were late on this months rent which was due on the 3rd but we did pay it today. Now they are giving us the choice to leave without eviction and pay a $600 termintion fee or be evicted and said it would go on our credit report. is that true?? can it hurt your credit score?? what should be do??

Clean the place and invite the landlord to see what you have done. It can hurt your credit rating so make a note of every thing you have done. It could end up in the small claims court, where your record of everything will be invaluable. Also if you have, or can borrow a video camera to show what you've done, that will be valuable as well.

Absolutely. They can file that against your credit. Just as a credit card company can file a late payment when you pay late on your credit card. The principal is the same. If you signed the lease, you agreed to the terms, one of which was the rent amount and the date it was due. If you fail to meet those requirements, you are in breach of contract and they can evict you. I would suggest you pay the $600 and leave with no damage to your credit and be done with it. Learn from your mistakes.

if the land lord took your money then what would he have to evict you on. If the place is not a wreck then take pic. Either way they have to serve with an eviction notice and then you have a court date and the judge rules. continue to pay your rent. Tell them if they have reasons to evict you then get a notice of decease and dismiss.

Clean it up and pay up. You could be headed to small claims court, and yes, it will go on your credit report. Once that happens, it will haunt you for the rest of your life. Better get yourself a lawyer and good luck.

take pictures of everything (after it is cleaned). you can fight her decision in court and she has to give you 30 days to move out. If I were you, I would clean, take pics and see her in court!
