Eight years thanks to the 2005 Bankruptcy Reform Act. If you file now and receive discharge in 2007 - you cannot file again until 2014 or 2015.

A person can file Chapter 7 again if it has been more than 8 years since he or she was discharged from the previous Chapter 7 bankruptcy.

Chapter 7 bankruptcy is a liquidation proceeding. The debtor turns over all non exempt nonexempt property to the bankruptcy trustee, who then converts it to cash for distribution to the creditors. The debtor receives a discharge of all discharageable debts. It used to be that you could file chapter 7 once every 6 years. However, October 17, 2005, the new law was effected and debtors can only file once every 8 years.
