You can ask for a continuance. They do it all the time. But you will have to show up at the court date. You need to talk to your public defender tomorrow and tell him or her what you want to do

Follow his instructions. The facts of your case will not be an issue. They will most likely offer you a good deal. Take it and avoid a trial.

And stay out of trouble in the mean time.

1) If you are unable to communicate with your lawyer, you need to ask the Court to appoint you another lawyer. Have you tried to set an appointment to talk to your public defender? If so, what happened? If you make multiple attempts and he is unable to speak with you, you might want to contact the Court and indicate that your attorney is not properly representing your rights. Either way, start keeping a journal of when you speak with your public defender, (or attempt to).. date, time, person left message with, etc.

2) You must show upon the court date to avoid a warrant for failure to appear. This is also a chance to tell the judge that you aren't being properly represented.

3) Consider hiring private attorney. They have a smaller caseload and therefore you may be able to communicate better with him/her. However, they don't work for free.

No one here can advise you how much time you are looking at without knowing much more details than you have provided and than is possible to do here. Consult an attorney who is properly licensed in your state for more information. For a referral, contact your state or local bar association.

Don't miss the trial date...go to the public defenders office to discuss the stratagy of your case. If you can call Legal Aid in your town...they maybe able to help you.
