my boyfriends mom & sister hired a lawyer that has been awful. They paid her half & I gave her another portion. There was some miscommunication, and she spoke to me in a very ill manner. She has not done anything except ask my boyfriend to give names. She also spoke to my boyfriend in a unprofessional manner. My boyfriend's sister & mother are clueless about the process and have left everything in my hands. I tried to speak to her in a civil manner (over the phone, haven't met with her b/c I'm 2 hours away) and tell her we want to seek other counsel, and she started screaming at me and calling me a "piece of ****" supposedly for her time wasted. I told her to keep the money and just give me the police report. I told her I was willing to go to Fresno (where she is located & my boyfriend is being detained) and pick it up and she refused. I don't know what to do...

I was involved in hiring her. I spoke to her before my boyfriends mom & sister jumped the gun and gave her any money. I wasn't able to go see her so I told them to meet with her. His sister has spoken to the lawyer and she was just as awful with her. I already threatened to report her to the BAR association. She said & I quote " go ahead its a long process I doubt you won't follow thru with it"... There was no agreement signed.

"Point your finger and say your fired"

Then cut all ties. Do not try to get the police report from her get it from who else the police. Do not talk to her and tell her you are requesting that she does not contact you any longer. Actually in writing is the best. If she contacts you after that you have her for harassment and sue her #ss. Make sure you sen the letter registered mail, so she has to sign for it.

Do not threaten her with a lawsuit or your going to report her. She doesn't care, you have no case and you will tick her off and legally screw with you.

Honestly, you just fire her. I am not sure how it is worked out regarding any retainer that she may still have that should be refunded.

I would suggest that your boyfriend and/or his mom get a Pre-Paid Legal plan. The attorney firm in California is, Parker Stanbury and they are great! The plan costs $17 or $26 a month and covers several things, anything not covered under the fee is provided at at LEAST a 25% discount. They are very professional and I think they could even handle this situation for you and get some money back.

Whomever signed the retainer is the one who is the client, and the one who has the right to seek other counsel.

From what you are saying, you aren't the client ... therefore she is under no obligation to ever even speak with you.

Sorry, but speaking to someone in an "unprofessional" or "ill" manner is not a crime.

What steps was she supposed to take? What services were outlined in the retainer?

You can go order your own copy of the police report. It's a public record.

I have no idea about the legal stuff that binds you to her, but it sounds like you should get your boyfriend's mom and sister to fire her. Because they hired her. Than go find a different lawyer and make sure that you both see eye to eye before you give him all your money. I hope everything works out.

She is your boyfriends lawyer, only he can fire her. Also, she may be doing more on the case then you realize. She can't discuss the case with you because she doesn't represent you. Discussing the case with you would violate attorney-client privilege. Any otherwise privileged information that she disclosed to you would become discoverable to the other side based on the vilolation of privilege. It doesn't matter who pays for the representation. Her only duty is to your boyfriend (her client) not to you or his mom or his sister. Stop harassing the attorney and potentially screwing up your boyfriends case and let her do her job.
