My brother was murdered and 1 was a juvinile.(there were 4 involved) the victium comp services have always let us know when court days were coming and so fourth. We just read on the internet web site,that she went to court yesterday, Oct 10. we were not notified this time...it says MOTION TO DISMISS CF-916 is sustained. There are no objections....what does that mean...She is 18 now, and has been in a juvinile detention center...My mom just found out, Does it mean all the charges are dropped or what???Is she free now, anyone know what sustained means on a murder case..we have been calling the court house all day, and no one has returned our calls yet....

On the internet all it says is Motion to dismiss CF-916 is sustained. There are no objections....So did all the charges get dropped? Looks like they are not calling us back today. So we will have to wait and wonder til tomorrow.dont be afraid to answer thinking you might not want to be hurtful...we want to know the truth....Thanks for all your answers...

What does it mean for a judge to "sustain" an objection?

A : One of your attorney's duties is to raise an appropriate "objection" to any violation of the rules governing the kinds of evidence the jury can and cannot weigh in deciding a case. When a court "sustains" your attorney's objection, it is telling your opponent's attorney that he or she is proceeding in violation of applicable procedural law and must correct his or her error. In addition, if an objection is sustained, the answer given is not in evidence and the jury will be instructed by the judge to disregard the answer.

Like the previous answer... the motion to dismiss being sustained means granted, which means it was dropped, BUT...

You'd need to look at just what the motion to dismiss applied to. It's possible that there were several charges in front of the court, but only one was the subject of that motion. It's possible that the defendant was charged with murder, conspiracy to commit murder, kidnapping, and robbery, and they dropped the conspiracy count.

Keep trying the court or watch the news. Something was dropped, but not necessarily everything.

LOL @ everyone's pictures. :-) I haven't actually seen Indi make a "mean" face before, I've never even seen her snarl or anything! I seriously just looked through all of my photos and couldn't find one.. talk about fail haha.
