In Texas, all you can ask is 1) Were they employed there. 2) How long. 3) Are they eligible for rehire. Those are the only questions, by Texas law, that you can ask. Any other information given must be voluntary by the previous employer.

Verify previous duties and responsibilities from previous position.

What were their attitude like towards the job

How did they get along with supervisor and co-wrokers? If yes, what sort of issues, how did they handle themselves.

How was their attendance and punctuality? How many days late or sick in teh last year.
Any unexcused absences?

Did they follow proper safety procedures while on the job?

Why did they leave the positon?

Most important, would you hire them back?

You can ask any merit-based question you desire. Age, gender, race, etc. are no-no's. Dates of employment, salary, job performance, awards, etc. are all OK.

Do keep in mind that many employers will only verify the employment dates and possibly the starting and final salary. They won't even answer the all-important, "Would you hire them back?" question.
