Being in jail is not the only reason I want a divorce from my husband. A few months ago he left without telling me where he was going. I didn't hear from him again until September and a few days after that he went to jail. So jail has nothing to do with this divorce.

In some states because he is in jail for more than a year you can get a no fault divorce. In a search engine type the name of your state and Divorce it should give you information.

Go to a lawyer. Tell them you want to file for divorce. They'll take care of the paperwork and explain everything to you.

You still may get the divorce without his signature but the process will be longer & more complicated. It will be much more easier if both of you signed the paper. Anyway, you should refer to you lawyer for more information.

If he knows that you want to divorce him. 1) he could give you limited power of attorney, preferable someone to sign on his behalf. 2) take the divorce papers to him, bring along a notary.
