my son's biological father owes 15,000 in child support. we went to court yesturday and since he hired a lawyer the day before they reset it for dec. he can pay a lawyer but demands he will never pay child support.i'm scared of him , he is violent , been in prison ,does drugs and i don't want my child around those kind of people,need to know if i should hire a lawyer and what legal steps are to pursade him to sign away his parental rights? thank you

Have you been given the option yet to file for a court appointed attorney? If not, then you can request a petition to terminate his rights from Family Court. You can either fill out the petition and file it yourself or take it to your lawyer, a legal aid office, or (possibly) to a domestic violence agency (some do it, some don't).

The judge will review your petition and will probably order an investigation in to his ability to parent. He will make a ruling based on the findings. It will only help your case if your ex refuses to pay child support. It will help your case if you have someone who wants to adopt your child (new husband). The court does not like to bastardize the child (their words, not mine). But they will in extreme circumstances. Just know that if your are successful in terminating his rights that you will never be able to go after him for support.

I would suggest hiring a lawyer and getting it all settled once and for all. It's you and your child's life. It's worth taking out a loan.
